1. Agreement to Terms

By accessing or using PriceTracker ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms comply with the Australian Consumer Law (ACL) and other applicable Australian laws.

2. Description of Service

PriceTracker is a price monitoring and tracking service that allows users to:

  • Track product prices from Australian and international retailers
  • Receive notifications when prices drop
  • View price history and trends
  • Access premium features through paid subscriptions

We provide information services only. We are not a retailer and do not sell products directly.

3. User Accounts

3.1 Registration

You must register for an account to use certain features. You agree to provide accurate, current, and complete information and to update it as necessary.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorized access.

3.3 Account Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through your account settings.

4. Free Trial and Subscriptions

4.1 Free Trial

New users may receive a 7-day free trial of premium features. No payment is required during the trial period. The trial will expire automatically unless you upgrade to a paid subscription.

4.2 Paid Subscriptions

Premium subscriptions are billed monthly at AUD $4.50 through PayPal. By subscribing, you authorize recurring charges to your payment method.

4.3 Cancellation and Refunds

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. Under Australian Consumer Law, you are entitled to a refund if:

  • The service has a major failure or does not match our description
  • We have not provided the service within a reasonable timeframe
  • The service is not fit for purpose as we represented

5. User Responsibilities and Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Use automated tools (bots, scrapers) without permission
  • Violate intellectual property rights
  • Submit false, misleading, or fraudulent information
  • Resell or redistribute the Service
  • Use the Service to spam or harass others

6. Accuracy of Information

We strive to provide accurate pricing information, but we cannot guarantee that all data is current, complete, or error-free. Prices and availability are subject to change without notice. Always verify information directly with the retailer before making a purchase.

7. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are owned by PriceTracker or its licensors and are protected by Australian and international copyright, trademark, and other intellectual property laws.

8. Third-Party Links and Services

Our Service contains links to third-party websites and uses third-party services (e.g., Amazon, eBay, Myer, PayPal). We are not responsible for:

  • The content or practices of third-party sites
  • Products purchased from retailers
  • Payment processing (handled by PayPal)
  • Delivery, returns, or customer service from retailers

9. Consumer Guarantees (Australian Consumer Law)

Nothing in these Terms excludes, restricts, or modifies any guarantee, warranty, term, or condition, right or remedy implied or imposed by the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted, or modified.

Our services come with guarantees that cannot be excluded under the ACL. For major failures with the service, you are entitled to:

  • Cancel your service contract and obtain a refund, or
  • Compensation for the drop in value

For minor failures, we are entitled to a reasonable opportunity to remedy the problem before you can claim a refund or compensation.

10. Limitation of Liability

To the maximum extent permitted by law, PriceTracker shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits or revenue
  • Loss of data or information
  • Business interruption
  • Missed price drops or opportunities
  • Reliance on inaccurate information

Nothing in these Terms limits our liability for fraud, gross negligence, or liability that cannot be excluded or limited under Australian law.

11. Indemnification

You agree to indemnify and hold harmless PriceTracker and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Service or violation of these Terms.

12. Service Availability

We strive to maintain Service availability but do not guarantee uninterrupted or error-free operation. We may suspend or discontinue the Service for maintenance, updates, or other reasons, with or without notice.

13. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Australia. Any disputes arising from these Terms or the Service shall be resolved in accordance with Australian law. You may seek resolution through:

  • Direct negotiation with us
  • Mediation or arbitration
  • The courts of Australia

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PriceTracker regarding the Service.

Australian Consumer Law Notice

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
